Terms of Service

These Terms of Service ("Terms") govern your access to and use of the Shark AI Visibility System and the website at ai-visibility.sharksuite.ai (the "Service"), operated by Shark Software LLC ("Shark", "we", "us", or "our"). By creating an account, subscribing, or otherwise using the Service, you agree to these Terms. If you do not agree, do not use the Service.
1. The Service
The Service analyzes how AI answer engines (including ChatGPT, Gemini, and Perplexity) and public online communities (including Reddit and Quora) reference your brand, and delivers visibility scores, reports, and engagement suggestions. The Service reads publicly available web pages and public community content to produce these results.
2. Accounts
You must provide a valid email address and are responsible for activity under your account. Sign-in uses a one-time link sent to your email. Keep access to that inbox secure. You must be at least 18 years old and able to form a binding contract. If you use the Service on behalf of a company, you represent that you are authorized to bind that company to these Terms.
3. Subscriptions, billing, and renewals
- The Service is sold on a recurring monthly subscription. The base plan covers one brand. Each additional brand is an added recurring charge, billed per brand.
- Adding a brand mid-cycle is prorated for the remainder of the current billing period, and is shown to you for confirmation before the charge is made.
- Subscriptions renew automatically each month until cancelled. Payment is processed by Stripe. By subscribing, you authorize us, through Stripe, to charge your payment method on a recurring basis.
- Current pricing is shown at the point of purchase. We may change pricing on a going-forward basis with notice before your next renewal.
4. Cancellations and refunds
You may cancel at any time. Cancellation stops future renewals; access continues until the end of the current paid period. Except where required by law, payments already made are non-refundable, including for partial periods of use. If you remove an additional brand slot, the recurring charge for that slot stops at the next cycle.
5. Acceptable use
You agree not to:
- Use the Service to violate any law, or the terms or rules of any third-party platform (including Reddit and Quora) when acting on suggestions we provide.
- Post spam, deceptive, or undisclosed promotional content. The Service surfaces opportunities and drafts; you are solely responsible for what you choose to publish.
- Resell, sublicense, scrape, or copy the Service or its outputs except as permitted by a separate written agreement.
- Attempt to gain unauthorized access to the Service, probe its security, or disrupt its operation.
- Submit brands, URLs, or content you do not own or are not authorized to monitor.
6. AI outputs and no guarantee of results
Visibility scores, citations, and recommendations are estimates, not guarantees. AI answer engines change constantly, citation data is sampled and depends on how a question is phrased, and some surfaces (such as Google AI Overviews) have no public data source and are not covered. The Service does not guarantee that you will be recommended, cited, or ranked by any AI engine or platform, or that following its suggestions will produce any particular result.
Outputs are generated in part by third-party AI models and may contain errors or omissions. Use professional judgment before acting on them.
7. Your content
You retain ownership of the brand information, URLs, and other content you submit ("Your Content"). You grant us a limited license to process Your Content solely to operate and improve the Service for you, including sending it to the third-party providers described in our Privacy Policy. You are responsible for the accuracy and legality of Your Content.
8. Intellectual property
The Service, including its software, design, scoring methodology, and brand, is owned by Shark Software LLC and its licensors and is protected by intellectual-property laws. These Terms grant you a limited, non-exclusive, non-transferable right to use the Service during your subscription. Reports we deliver to you are yours to use for your own business.
9. Third-party services
The Service relies on third-party providers for hosting, authentication, payments, email, and AI analysis. Your use of the Service is also subject to those providers' availability. We are not responsible for outages, changes, or actions of third-party platforms whose public content we analyze.
10. Disclaimers
The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or that results will be accurate or reliable.
11. Limitation of liability
To the maximum extent permitted by law, Shark Software LLC and its officers, members, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenue, data, or goodwill, arising from or related to the Service. Our total liability for any claim relating to the Service will not exceed the amount you paid us in the three (3) months before the event giving rise to the claim.
12. Indemnification
You agree to indemnify and hold harmless Shark Software LLC from any claims, damages, or expenses (including reasonable legal fees) arising from Your Content, your use of the Service, or your violation of these Terms or of any third-party rights or platform rules.
13. Termination
We may suspend or terminate your access if you breach these Terms, fail to pay, or use the Service in a way that creates risk or legal exposure for us or others. You may stop using the Service at any time. Sections that by their nature should survive termination (including ownership, disclaimers, limitation of liability, and indemnification) will survive.
14. Changes to these Terms
We may update these Terms from time to time. If we make material changes, we will update the "Last updated" date and, where appropriate, notify you by email. Continued use of the Service after changes take effect constitutes acceptance.
15. Governing law
These Terms are governed by the laws of the State of New Jersey and applicable United States federal law, without regard to conflict-of-laws rules. The exclusive venue for disputes will be the state or federal courts located in New Jersey, and you consent to their jurisdiction.
